Are E-Cigs Legal in Colorado? For the Moment, Yes
March 7, 2011 – As the latest state to consider legal action on electronic cigarettes, Colorado’s legislature is in the process of considering a bill to restrict sales of the devices. Like many of the other states, Colorado simply believes it best to make sure electronic cigarettes are kept out of the hands of minors.
As it is currently written, no further restrictions will be placed on e-cigarette sales in this bill. This is very reasonable, considering that more activist states like New York have considered banning the devices altogether! The law would simply incorporate e-cigs into the definition of traditional cigarettes in order to maintain restrictions on sales to persons under 18, the age limit for cigarette purchases in Colorado.
We expect to see a lot more similar actions by states in the coming months as minor purchases continue to be a concern to many legislators, and as people continue to see electronic cigarette market as the best alternative to regular cigarettes.
While the Colorado House has already approved a bill, the measure will next go before the Senate prior to the governor’s desk. No opposition has been raised, and most expect it should pass easily.
